Terms of Service for TemplateDocs

Welcome to TemplateDocs. Please read these Terms of Service ("Terms") carefully before using our services. TemplateDocs is operated by ByteSail, located at Kfar Adummim, Israel ("TemplateDocs," "we," "us," or "our").

1. Acceptance of Terms

By accessing or using TemplateDocs (the "Service"), you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. In that case, "you" and "your" refer to that organization.

2. Description of Service

TemplateDocs provides a web application and API for automating document workflows. The Service may be used to collect data, process input data, generate documents, and deliver or transfer workflow results through supported integrations. The Service is accessible at https://templatedocs.io.

3. User Accounts

To use our Service, you must provide accurate and complete registration information. You are responsible for maintaining the security of your account credentials and for activity performed through your account. You are responsible for managing access to your organization and for ensuring that users you authorize comply with these Terms.

4. Ownership and Intellectual Property

• You retain all rights and ownership in templates, documents, data, workflow content, form submissions, and other content that you or your users submit to or process through the Service ("Customer Data").
• You grant TemplateDocs the limited rights necessary to host, process, transmit, display, and otherwise handle Customer Data solely to provide, secure, maintain, and support the Service, comply with law, and enforce these Terms.
• TemplateDocs retains all rights to the Service's software, technology, documentation, and infrastructure.

You are responsible for ensuring that you have all rights and permissions necessary to submit and process Customer Data through the Service.

5. Data Collection and Privacy

Our collection and use of personal information is described in our Privacy Policy at https://templatedocs.io/privacy.

Where TemplateDocs processes personal data contained in Customer Data on your behalf, the TemplateDocs Data Processing Addendum ("DPA") at https://templatedocs.io/dpa applies and is incorporated into these Terms. By accepting these Terms, you also accept the DPA.

You are responsible for determining what Customer Data you collect and process through the Service and for complying with applicable privacy and data protection laws. This includes, where applicable, establishing a lawful basis for processing, providing required notices to individuals, and obtaining any required consents.

6. Payment Terms

Access to paid features of the Service requires purchase of a subscription or package. Pricing and payment terms are specified at the time of purchase.

Plans labeled as "Unlimited templates" allow for up to 1,000 templates. Plans labeled as "Unlimited workflows" allow for up to 1,000 workflows. These limits are designed to prevent abuse while ensuring sufficient capacity for legitimate business use.

Payments are processed by Paddle, which acts as merchant of record. TemplateDocs does not directly receive or store full payment card details.

7. Cancellation and Refund Rights

You have the right to cancel your purchase and receive a full refund within 14 days from the day after your purchase is completed, without providing any reason.

To cancel your purchase, you must inform us of your decision to cancel by sending an email to support@templatedocs.io. For immediate processing, please include your account email address and purchase date in your cancellation request.

Please note that for subscription services, your right to cancel and receive a refund applies only to the initial subscription purchase and not to subsequent automatic renewals.

The right to cancel and receive a refund does not apply if you have used more than 10% of your quota or generated more than 30 documents, whichever is lower.

8. Prohibited Activities

As a user of our Service, you agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to, interfere with, or disrupt the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Create, upload, or distribute harmful, inappropriate, or prohibited content, including but not limited to: harassment, hate speech, violence, self-harm, sexual or pornographic content, weapons-related content, promotion of cryptocurrency, gambling, pirated streaming, phishing, spam, and malware
• Use the Service to process protected health information where HIPAA compliance is required, or to directly collect or store payment card data requiring PCI DSS compliance
• Engage in any other activity that we reasonably determine may harm the Service, its users, or our business interests

You are responsible for determining whether the Service is appropriate for your particular legal, regulatory, and compliance requirements.

9. Third-Party Services and Integrations

The Service may allow you to connect to or send data to third-party services, including services that you configure yourself. Where you choose and configure a third-party integration or destination, you are responsible for your use of that service and for instructing TemplateDocs to transmit Customer Data to it. Third-party services are governed by their own terms and privacy practices. TemplateDocs may also use subprocessors to provide the Service, as described in the DPA and Privacy Policy.

10. Service Moderation and Security

To protect the Service and prevent abuse, TemplateDocs may automatically scan outbound workflow emails and embedded URLs using automated moderation and security services. Such processing is used for security, abuse prevention, and operation of the Service. Public forms may display "Powered by TemplateDocs" or similar service branding. You remain responsible for providing any privacy notice or other information required for individuals who submit data through your forms.

11. Termination

We reserve the right to terminate or suspend access to our Service immediately, without prior notice, for any violation of these Terms or where reasonably necessary to protect the Service, its users, or third parties. You may delete your account through the Service where available or by contacting support.

12. Changes to Terms

We may modify these Terms from time to time. We will notify users of material changes by email or through the Service. Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.

13. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by applicable law. TemplateDocs and ByteSail shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

14. Governing Law

These Terms shall be governed by the laws of Israel, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
